Terms of Service

1. Agreement to Terms

By accessing or using NilesAI ("the Service"), operated by Avesso LLC ("we," "our," or "us"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service.

2. Description of Service

NilesAI is a medical bill analysis platform that scans uploaded billing documents against federal compliance databases, CMS rules, NCCI edits, Medicare fee schedules, and MUE limits to identify potential overbilling. The Service generates findings reports and dispute letters based on this analysis.

3. Not Medical or Legal Advice

The Service provides informational analysis only. NilesAI does not provide medical advice, legal advice, or professional billing consultation. Findings are based on publicly available federal billing rules and should be independently verified. You should consult qualified professionals before taking action based on our reports.

4. Account Registration

You must provide accurate and complete information when creating an account. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

5. Free Tier

  • Free accounts include up to 3 bill scans per month with full compliance analysis and summary reports.
  • Detailed reports with full citations and dispute letters are available for $29 per case when overbilling findings meet the minimum threshold.
  • No credit card is required for the free tier.
  • We reserve the right to modify free tier limits with 30 days' notice.

6. Paid Plans and Billing

  • Paid plans (Starter, Professional, Enterprise) are billed monthly in advance.
  • Additional cases beyond your plan's monthly allotment are billed at per-case rates specified in your plan.
  • You may cancel your subscription at any time. Cancellation takes effect at the end of the current billing period.
  • Refunds are not provided for partial billing periods. If you believe you were charged in error, contact us within 30 days.
  • We reserve the right to change pricing with 30 days' notice to existing customers.

7. Acceptable Use

You agree not to:

  • Upload documents you do not have the legal right to access or analyze.
  • Use the Service for fraudulent purposes or to generate false claims.
  • Attempt to reverse-engineer, scrape, or extract our compliance databases or analysis algorithms.
  • Use automated tools to access the Service beyond normal usage patterns.
  • Share your account credentials with third parties.

8. Intellectual Property

You retain ownership of all documents you upload. You grant us a limited, non-exclusive license to process your documents solely for the purpose of providing the Service.

All analysis reports, dispute letter templates, compliance rules, software, and other materials provided through the Service are the intellectual property of Avesso LLC. You may use generated reports and dispute letters for their intended purpose (disputing medical bills) but may not resell or redistribute them.

9. Limitation of Liability

To the maximum extent permitted by law:

  • The Service is provided "as is" without warranties of any kind, express or implied.
  • We do not guarantee the accuracy, completeness, or reliability of any analysis or report.
  • We are not liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service.
  • Our total liability for any claim arising from the Service is limited to the amount you paid us in the 12 months preceding the claim.

10. Dispute Resolution

Any disputes arising from these Terms or the Service will be resolved through binding arbitration administered by the American Arbitration Association under its Commercial Arbitration Rules. Arbitration will take place in the State of Florida. You agree to waive any right to participate in a class action lawsuit or class-wide arbitration.

11. Termination

We may suspend or terminate your account if you violate these Terms. Upon termination, your right to use the Service ceases immediately. Sections regarding intellectual property, limitation of liability, and dispute resolution survive termination.

12. Changes to Terms

We may update these Terms from time to time. Material changes will be communicated via email or a prominent notice on our website at least 30 days before taking effect. Continued use of the Service constitutes acceptance of updated Terms.
